These Terms and Conditions (“Terms”) govern your access to and use of the Humble Down website, and any purchase of Humble Down products (including apparel and the “Hum” plush toy) (collectively, “Products”). By using our site or purchasing Products, you agree to these Terms. If you do not agree, do not use the site or purchase Products.

1. About Humble Down

Humble Down (“Humble Down”, “we”, “us”, “our”) offers made-to-order and/or small-batch apparel and plush products. Some Products are manufactured by third-party partners on Humble Down’s behalf, including: (a) Silk Style Exports (apparel manufacturing) and (b) Stuffed Animal Pros (Hum plush toy manufacturing).

Important: Your purchase is from Humble Down. However, because manufacturing and logistics may be performed by partners, certain production, cancellation, and quality processes are influenced by partner policies and practical constraints, as described in these Terms.

2. Eligibility

You must be at least 18 years old (or the age of majority where you live) to place an order. If you are under the age of majority, a parent or legal guardian must place the order and accept these Terms on your behalf.

3. Orders, Customization, and Acceptance

(a) Order acceptance. We may accept or decline any order at our discretion (for example, due to stock, production capacity, fraud risk, or intellectual property concerns). Your order is accepted when we send an order-confirmation email or otherwise confirm acceptance.

(b) Custom and made-to-order items. Many Humble Down Products are custom, made-to-order, or manufactured in small runs. Because custom production begins soon after order confirmation, changes and cancellations may be limited (see Section 6).

(c) Accuracy of information. You are responsible for providing accurate information (including size selections, shipping address, and any customization details). We are not responsible for delays or losses caused by inaccurate information.

4. Pricing, Taxes, and Payment

(a) Pricing. Prices are shown at checkout in the currency displayed on the site. We may change prices at any time, but changes will not affect orders already accepted.

(b) Taxes and duties. Sales tax may be collected where required. For international orders, you are responsible for any import duties, customs fees, or taxes charged by your destination country.

(c) Payment timing. Your payment method may be charged at the time of purchase. For certain customs or large orders, we may request a deposit and/or milestone payments.

5. Production Timelines and Shipping

(a) Production timelines are estimates. Because Products may be manufactured to order, production and shipping timelines are estimates and are not guaranteed.

(b) Shipping and risk of loss. Title and risk of loss pass to you upon delivery to the carrier, unless otherwise required by applicable law.

(c) Delays. Delays may occur due to production capacity, material availability, customs clearance, weather, carrier issues, or other circumstances outside our control.

6. Cancellations, Changes, Returns, and Refunds

6.1 Cancellations and changes

Because many Products are custom and production begins quickly, cancellation and change windows are limited. If you need to request a change or cancellation, contact us immediately.

  • Apparel (manufactured via Silk Style Exports): In general, cancellations may only be possible before sourcing/procurement of fabric and materials begins. Once production has begun, cancellation is typically not available.
  • Hum plush toys (manufactured via Stuffed Animal Pros): Bulk production typically begins after sample approvals and payment of a non-refundable deposit. Once mass production is initiated, it generally cannot be stopped.

6.2 Returns and refunds

(a) Made-to-order and personalized items. Unless required by law, made-to-order, personalized, or custom items are generally final sale and non-refundable, except for defects, damage in transit, or items materially not as described.

(b) Defects or damage in transit. If your item arrives damaged or defective, contact us within a reasonable time (and at any event within 15 days of delivery for bulk plush orders) with photos of the issue and your order number. We will work with you to repair, replace, or (where appropriate) refund the affected item.

(c) Standard (non-custom) returns. If we offer a return window for a non-custom item, the item must be unused, unwashed, and in original condition with tags/packaging. Return shipping costs are generally the customer’s responsibility unless the return is due to our error or a verified defect.

(d) Chargebacks. Please contact us before initiating a chargeback so we can try to resolve the issue. Unjustified chargebacks may result in order cancellation and/or refusal of future orders.

7. Intellectual Property and Content

All trademarks, logos, product names, designs, and site content are owned by Humble Down or its licensors and are protected by intellectual property laws. You may not use our content for commercial purposes without written permission.

Custom submissions: If you submit artwork, logos, or other content for customization, you represent that you have the rights or have permission to use it. You agree not to submit content that infringes third-party rights (including copyrighted or trademarked characters) or violates any law.

8. Product Safety and Care

Please follow care instructions provided with the Product. Our plush toys are intended for the age group indicated on the product listing/labeling. Adult supervision is recommended for young children. Humble Down is not responsible for misuse, improper care, or normal wear-and-tear.

9. Disclaimer of Warranties

To the fullest extent permitted by law, the site and Products are provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the fullest extent permitted by law, Humble Down will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or related to your use of the site or purchase/use of Products. Our total liability for any claim will not exceed the amount you paid for the Product, giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless Humble Down and its officers, directors, employees, contractors, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, your misuse of the site or Products, or your submission of infringing or unlawful content.

12. Dispute Resolution and Governing Law

These Terms are governed by the laws of the state/province where Humble Down is established, without regard to conflict-of-law rules. You and Humble Down agree to attempt to resolve disputes informally first.

Optional arbitration clause: If you prefer, you may add an arbitration provision (often used in U.S. ecommerce terms). If you want this included, tell us your preferred governing state and whether you want binding arbitration or court litigation.

13. Privacy

Our collection and use of personal information is described in our Privacy Policy.

14. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date above indicates when changes were made. Continued use of the site or purchases after changes means you accept the updated Terms.

Supplier Terms Addendum (Manufacturing Partners)

This Addendum summarizes certain manufacturing partner terms that can affect production timelines, cancellations, shipping, and remedies. These partner terms are provided by the partners and may change. If there is a conflict between this summary and the partner’s published terms, the partner’s published terms control for the manufacturing portion of the transaction.

  • Payment: Silk Style’s orders are non-refundable.

B. Stuffed Animal Pros (Hum plush manufacturing) – highlights-non-refundable.

C. Humble Down (website returns)

*Humble Down orders in bulk. Due to the nature of overseas manufacturing, tariffs, and shipping costs, Humble Down is unable to offer refunds or exchanges currently.
